Types of Tenancy

Tenants in Common
Each owner or tenant has right to use the property.  If one of the owners dies his/her interest in the property is distributed according to his/her will and if there is no will then to his/her heirs.


Joint Tenancy
This is also known as joint tenancy with right of survivorship.  Each owner is entitled to use of the property and on his/her death the ownership of the deceased is automatically owned by the surviving owner.


Tenants by the Entirety  
This is a special form of tenancy that can only be used by two married persons.  It is similar to a joint tenancy.  The deed or other document must list the parties “As Tenants By the Entirety”, “as husband and wife”, “his wife” or “her husband”
